Monilo terms and conditions
Definitions
In this document, you are described as the client. People that use Monilo on your site are described as customers. A request is when someone asks Monilo to send your contact details to their mobile as an SMS business card. Here we go!
Monilo
When someone who visits your website clicks on the Monilo link, they can enter their mobile number into a small box that appears and receive your contact details as an SMS business card.
Your responsibility
As a client, you are responsible for the content of this business card as Monilo will send out exactly the information you give when you create each business card in Monilo's client section.
You are also responsible for copying the code we give you, to include Monilo on your site, accurately and in the location you desire. Sorry, but we can't help you with placing code on your site.
Monilo will only continue to send out your details in response to a request as long as you have enough credit in your account. We'll always tell you when your credit is running low. But if it runs out completely, then the Monilo link on your website will automatically disappear.
Our responsibility
We are responsible for ensuring that the Monilo function is available on your website continuously. However, due to issues of connectivity via the internet, this might not always be possible. If it isn't possible, we accept no liability but we will work to rectify any issues as quickly as possible.
We are also responsible for ensuring that, every time a customer makes a request, an SMS business card is sent from our SMS gateway to the mobile of the client who has made the request. However, once the SMS business card has left our gateway, it is up to the mobile networks to deliver it. Any network issues, including non-delivery or delay, are beyond our control and we can't take responsibility for them.
Costs
The first SMS business card you create comes with a 30 day free trial. This means you don't pay the usual monthly fee of £4.95, which kicks in after the first 30 days. Any additional business cards you create don't come with a free trial and you'll be charged as soon as you set the card live.
The monthly payment (and the free trial on your first business card) includes 30 free requests. We will send your details out 30 times for free per business card every month. In any given month, after you have used up your 30 free requests, each additional request is charged at 9p.
If you turn on Monilo+, we need to send an additional message to each of your customers when we send them your details. Each of these messages costs 5p and none are included in your monthly payment. When you then use Monilo+ to send out promotional messages, each message you send costs 10p.
Payment details and topping up
You need to register payment details at the beginning of your free trial so we can take payment for any requests that come in over and above the first free 30. Whatever payment details you enter will be the ones we use for taking any monthly and usage fees on an ongoing basis. You can choose to pay by credit or debit card or via PayPal.
To ensure continuity of the service, you can choose to automatically top up your account as your credit falls as customers use Monilo on your site. If you do this, you make an initial payment of an amount you specify and then any following automatic payments are taken at the same level. You can change this automatic top up amount whenever you like. We'll send you an email or a text when we're about to take an automatic top up. Automatic top ups are only available if you're paying by credit or debit card.
You can also choose to top up manually. We'll send you an email or text when your credit gets low then you can log in and top up manually.
Monilo+
You can choose to collect the mobile numbers of users who request your contact details using Monilo on your site. If you turn Monilo+ on, then each customer who uses Monilo on your site will receive, in addition to their SMS business card, a message asking them if they would like to receive promotional messages from your company. If they reply with the word YES, then their mobile number is registered in your account and you can send promotional messages to them.
You will not have access to the full mobile numbers collected, for data protection and regulatory reasons. You may not use Monilo+ to send out messages to anyone other than customers whose mobile numbers Monilo has collected on your behalf. Monilo+ is calibrated so that you cannot send out more than one message to any individual mobile number within a 7 day period.
Sending messages
Any messages sent out using Monilo+ will be sent via our SMS gateway. We are responsible for the messages being sent from our gateway to the mobile networks. However, we are not then responsible for ultimate delivery of the messages to user's phones. This responsibility lies with the mobile networks.
You won't be able to view any replies your customers send back as they're not monitored or collected.
Customer unsubscribing
Each message you send out via Monilo+ will contain automatically generated text informing the customer that, if they would like to stop receiving messages, they should reply with the word STOP. The mobile number of any customer who does this is automatically removed from your phonebook list in Monilo+.
Monilo Directory
The Monilo Directory is a searchable directory of business listings available on the mobile internet only.
You can choose to list your business on the directory. Your directory listing will consist of the information you provide. You are responsible for ensuring that the information is correct and up-to-date.
